Terms of Use

1. Acceptance of Terms

By accessing or using PartnerLink (“the Platform”), you agree to these Terms of Use. If you do not agree, do not use the Platform.

2. Platform Role

PartnerLink is a connection and information platform for property flippers, developers, and private capital partners. PartnerLink does not provide credit, financial advice, broking, underwriting, escrow, settlement, legal, tax, or transaction services.

Any funding arrangement is a private agreement between the relevant users. PartnerLink is not a party to those arrangements and does not guarantee funding, repayment, returns, deal quality, or user conduct.

3. Eligibility and Accounts

You must be at least 18 years old and able to enter legally binding agreements. You are responsible for providing accurate information, keeping your login details secure, and ensuring activity under your account complies with these terms.

4. Partner Profiles and Proposals

Partners are responsible for the accuracy of their profile, criteria, claimed experience, availability, fees, interest ranges, response times, and supporting material. Flippers are responsible for the accuracy of proposal details, property information, funding requirements, exit strategy, and uploaded documents.

We may review, moderate, hide, or remove profile and proposal content if it appears incomplete, misleading, unlawful, unsafe, or inconsistent with the Platform’s purpose.

5. Partner Standards

These Terms of Use supersede any separate partner guideline language. Partners must present themselves honestly, respond professionally, keep criteria current, avoid misleading claims, and comply with all laws that apply to their lending, investment, advisory, marketing, or business activity.

PartnerLink may suspend or remove a partner profile for suspected misrepresentation, repeated complaints, abusive conduct, spam, attempts to bypass the Platform in bad faith, or activity that creates regulatory or reputational risk.

6. User Conduct

You must not use the Platform to post false information, impersonate another person, harass users, scrape data, upload malicious files, bypass security controls, spam users, or promote unlawful financial arrangements.

7. Due Diligence

Users must conduct their own due diligence before entering any financial arrangement. This includes verifying identity, authority, property details, security, documents, legal obligations, fees, repayment terms, risk, and regulatory requirements. You should obtain independent legal, financial, tax, and property advice before making commitments.

8. Fees and Payments

Some Platform features may require a paid subscription. Subscription pricing, inclusions, billing periods, and cancellation settings are shown on the Pricing page or account billing portal. Fees are non-refundable except where required by law or expressly stated in writing.

9. Reviews and Messaging

Reviews must reflect genuine experiences and must not be defamatory, abusive, misleading, incentivised without disclosure, or posted on behalf of another person. Messages may be monitored or reviewed when needed for safety, support, fraud prevention, or legal compliance.

10. Intellectual Property

PartnerLink owns or licenses the Platform, brand, design, copy, code, and related intellectual property. You retain ownership of content you submit, but grant PartnerLink a licence to host, display, process, and use that content to operate and improve the Platform.

11. Limitation of Liability

To the maximum extent permitted by law, PartnerLink is not liable for indirect, incidental, special, consequential, punitive, or financial loss arising from use of the Platform or arrangements between users. PartnerLink’s total liability is limited to the amount you paid to use the Platform in the 12 months before the claim.

12. Suspension and Termination

We may suspend or terminate access if you breach these terms, create safety or compliance risk, provide misleading information, abuse another user, or use the Platform in a way that harms PartnerLink or its users. You may close your account through account settings or by contacting support.

13. Changes to Terms

We may update these terms from time to time. Continued use of the Platform after changes are published means you accept the updated terms.

14. Governing Law

These terms are governed by the laws of Australia. Any dispute will be handled in the courts with jurisdiction over the relevant Australian state or territory unless applicable law requires otherwise.
